Introduction


3B Games Minigolf Leagues

Welcome to 3B Games Mini Golf Leagues (the "Contest"), where you can start your own 10-player league or join an existing one. No matter what your skill level, we'll have plenty of leagues to choose from. Most leagues include a description of the type of player the league is looking to recruit, so you should have no trouble finding a league that is right for you. The rules for Minigolf Leagues are explained fully in this document.

The Administrator

3B Games LLC (3B Games) will serve as the administrator for all Mini Golf Leagues and will be responsible for resolving any disputes that arise regarding violations of applicable Official Rules or anything else that may come up in connection with a Contest.

League Signup


Signing Up and Fees

You can sign up for 3B Games Mini Golf Leagues anytime up to 11:59:59 PM ET on the Sunday before the league starts. Signup cost depends on the level of competition you choose. There is no fee to play in our free leagues, however you are limited to only 3 entries. Costs for our fee-entry leagues are: Intermediate level - $9.95 per player; Pro level - $19.95 per player; Championship level - $49.95 per player. If you are not an account holder, you will be prompted to register for an account prior to signing up for fee-entry leagues. We will provide a list of available leagues for you to choose from after you sign up.

To sign up to play in a Mini Golf League you will need to go to the League Signup Page. Once you are on the League Signup Page, choose which level of competition you want and click the Submit Entry button.

For free leagues, no further information is required and a popup window will appear and say that your entry was successful. For fee-entry leagues, you will be taken to a confirmation page showing which league level you are about to enter, your current account balance, and your resulting account balance. If everything is correct, click yes to continue; if not, click no. If selecting yes a popup window will appear and say that your entry was successful.

After submitting your entry you will be directed to the join a league page where you will choose which league to join. After joining your league, you will see your entry in the Leagues Entered Box.

Joining a League

After submitting an entry to play in a league, you will need to join a league. To view the list of available leagues, click on the View Leagues link in the League Entries box on the League Page. This link will appear after you have submitted an entry to play in a league. When you have found a league you want to join, click on the Join link for that league and you will be entered into that league. If it is a private league, you will need the password to join. You can review the weekly courses by clicking the View link. To access a league you have joined, simply click on the league name in the League Entries box. If you wish to delete your entry into a league you joined and join a different league, simply click the Join Another League link in the League column in the Leagues Entries box.

Create a League

If you can't find a league you want to join, you can create a league. Click on the Create a League link on the top of the List of Available Leagues page. Just fill out the following information to create your league.

1. Enter a League Name.
2. Enter commissioner notes.
3. Enter the Availability. Public - anyone can join. Private - players will need the password to join.
4. Choose a League Type - Rotisserie or Continuous.
5. Enter a password if your league will be a private league.
6. Click the Next Step button.
7. Enter the courses and green speeds for each week or click on the Select All Random button.
8. Click the Next Step button.
9. Review the settings and click the Create League button.

A created league will be deleted if at any time it has zero entries. All leagues are required to have 10 players.

Private Leagues or Public Leagues

Public leagues are open to anybody. If you create or join a Public league, you will have no control over who joins the league. Be sure to read the description and settings of the league you want to join to make sure it is suitable for you.

If you know all the players who are going to be in your league, or you want to recruit individuals, you may want to join or create a Private league. The person who creates a Private league sets a password and other owners use that password to join the league.

Signup Deadline

You can sign up and join a league anytime up to 11:59:59 PM ET on 10/09/2005.

Refund Policy

After you sign up for a League, you may receive a full refund of the purchase price up to 48 hours prior to the league's start time. All other refund requests will be subject to the sole discretion of 3B Games.

Continuous Leagues
Overview

Each week you will play 5 rounds of mini golf. In the Continuous leagues scores accumulate from each round of each week. All of the scores from each round are added up each week and the player who has the lowest score wins.

Player 5 is the winner with the best total score of 1938.

Forfeits and Uncompleted Rounds

If a player fails to complete a round then his score for that round will be 5 strokes over the highest score for the round. So if a player doesn't play a round and the highest score for that round is 45, then the players score will be a 50.

Winner

The winner of a Continuous League will be the player who has the lowest total score. In the event of a tie, the tiebreaker will be the lowest 5-round score on week 10. If there is still a tie, then the lowest 5-round score for week 9; and if still a tie, then week 8, and so on. If there is still a tie after week 1, the prize will be split.

Rotisserie Leagues
Overview

Each week you will play 5 rounds of mini golf. In the Rotisserie leagues points are awarded for each round. The player with the lowest round earns 10 points. The player with the next lowest round earns 9 points and so on to the player with the highest round who earns 1 point. In the event of a tie for a round the players who tied will split the points. So if 2 people tie for 4th place for a round then they will each earn 6.5 points ((7+6)/2). At the end of the league the player who ends up with the most points wins.

Forfeits and Uncompleted Rounds

If a player fails to complete a round then his score for that round will be 1 point. If two or more players forfeit or fail to complete a round then they will all be considered for a tie for last place and split the points. So if 3 people fail to finish a round then each will earn 2 points ((1+2+3)/3).

Winner

The winner of a Rotisserie League will be the player who scores the most points. In the event of a tie, the winner will be the player with the lowest score for all rounds played during the league.

To play a round in the league go to your leagues site by clicking on the League link at the top of the page then click the link for your league in the Leagues Entered box. To begin play in the league simply click the blinking golf ball in the Score Card Table. Be sure to have your popup blocker deactivated or allow a pop up to come up on your screen. Failure to do so could result in inability to play your round, which will result in a forfeit. The blinking golf ball will indicate that you are on Round 1. After clicking the golf ball you will be taken to the Tee Off Screen, which shows the Player Name, League Name, Division, Round Number, Course Name, and Course Speed. Click the Tee Off button when you are ready, and you will be taken to Hole #1 of your current round. Play your round and complete all 18 holes, after which you will be taken to the Scorecard where your score will post automatically. After the words "Score Posted Successfully" appear, you may click the Continue button whenever you have finished viewing your Scorecard.

After clicking the Continue button you will be redirected to the League Page. You will notice that your score has been posted and the golf ball is now blinking on Round 2. Whenever you are ready to continue with the league simply follow the same steps you took in Round 1 and advance through the rounds until you have completed all 5 rounds. You must complete all 5 rounds each week in the time allotted for the league.

Prizes


League Champion Prize
The first-place finisher in each Intermediate League will win Sixty Dollars ($60).
The first-place finisher in each Pro League will win One Hundred Fifty Dollars ($150).
The first-place finisher in each Championship league will win Four Hundred Dollars ($400).

NOTE: There are no prizes awarded to free league winners.

Players will receive player points for entering leagues and winning their league.

If there happens to be a tie for a 1st place, each player will receive the points awarded for 1st place.

Prize Notification

To determine eligibility, we will notify you via e-mail. Potential winners will be required to sign and return, within thirty (30) days of issuance, an Affidavit of Eligibility and Publicity (unless prohibited by law)/Liability Release. Failure to return such documents within the specified time period, noncompliance with these Official Rules, the return of any prize or prize notification or if any potential winner declines a prize for any reason, prize may be awarded to the entrant with the next lowest score or most points ( as applicable). When we receive the affidavit, your account will be credited with your cash prize.

Sportsmanship


General Sportsmanship

By participating, you agree to abide by the general sportsmanship rules set forth in these rules. You further agree to accept and abide by the rulings and the decisions of 3B Games regarding all questions of sportsmanship. If a player does not comply with the sportsmanship rules as defined in these official rules, or 3B Games determines (in 3B Games' sole discretion) that a player has acted in an unsportsmanlike manner, 3B Games reserves the right to disqualify the player. Before doing so, 3B Games will contact the player for an explanation. 3B Games will evaluate the explanation and decide, in its sole discretion, whether or not to disqualify the player in question. All decisions by 3B Games in sportsmanship and related matters will be final.

Multiple Teams

In order to keep the leagues as competitive as possible, players will only be allowed to have one team in a league. If it is discovered that two or more teams are being operated by one player in the same league, 3B Games reserves the right to disqualify that owner from participating in any mini golf league.

Inappropriate League Communication

The League Message Boards are available for you to communicate with other league players. We ask that you refrain from posting or sending messages that could be construed as offensive to other players. If 3B Games determines, at it's sole discretion, that someone is engaging in inappropriate communication, 3B Games reserves the right to disqualify that person from participating in any Minigolf Leagues.

Legal Terms


All participants agree to abide by the terms of these Official Rules, and by the decisions of 3B Games, which are final and binding on all matters pertaining to the Contest.

Eligibility

3B Games Minigolf Leagues for free levels are open to all 3B Games members.

3B Games Minigolf Leagues for Intermediate, Pro, and Championship levels are open to 3B Games members who are registered account holders, available to natural persons at least 18 years old who are:

United States
(a) assigned the e-mail address on their registration form;
(b) U.S. citizens or resident aliens with a U.S. address;
(c) physically located within the U.S.; and are
(d) physically located in a state in which participation in the Contest is unrestricted by law. Fee-based contests with prizes are not allowed to residents of the following states: Arkansas, Arizona, Delaware, Florida, Iowa, Louisiana, Maryland and Tennessee.

Non-U.S.
(a) assigned the e-mail address submitted on their registration form. U.S. residents must not be from one of the restricted states.

Employees and members of the immediate families (immediate family is defined as parent, sibling, child, spouse, or any person residing the in the same household as employee) of 3B Games are not eligible to play.

General Conditions

By entering, each entrant accepts and agrees to be bound by these rules and by the decision of the judges, which shall be final and binding in all respects. Further, each entrant also acknowledges and agrees to the 3B Games Terms of Service, including, without limitation, the 3B Games Acceptable Use Policy. Taxes, if any, are the sole responsibility of the prize winners. No substitution or transfer of prizes permitted except by 3B Games. 3B Games reserves the right to substitute a prize for one of equal or greater value in the event that an advertised prize is unavailable.

All prize winners may be required to submit valid identification to 3B Games and to execute an affidavit of eligibility and a liability release within thirty (30) days following first attempted notification. Failure to comply within this time period may result in disqualification and awarding of the prize to the entrant with the next best score or points (as applicable).

Entrants agree to 3B Games' use of their names and likeness for advertising and publicity purposes, without additional compensation, unless prohibited by law. All prize winners will be required to execute a publicity release, unless prohibited by law.

All federal, state and local laws and regulations apply.

3B Games is not responsible for lost, late or misdirected on-line entries or transactions, for incorrect, inaccurate or incomplete entry information whether caused by a entrant, equipment, or technical malfunction or for any human error, technical error or malfunctions. 3B Games reserves the right to halt or modify the Contest at any time during the Contest period if events beyond their control compromise the Contest's fairness or integrity.

3B Games is not responsible for typographical or other human or technical errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prizes.

3B Games, in its sole discretion, may disqualify any entrant from participating in the Contest, refuse to award points or prizes, and require the return of any prizes, if entrant engages in any conduct 3B Games deems to be improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during account registration or prize claim, violating any term or condition stated herein, accumulating points or prizes through methods such as automated computer scripts or other programming techniques, allowing others to use the entrant's personal information for the purpose of accumulating points or prizes, tampering with 3B Games's administration of this promotion, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on this 3B Games Web site. Entrant further acknowledges that the forfeiture of prize(s) and/or return of any prize(s) shall in no way prevent 3B Games from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct.

3B Games reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Contest.

This Contest may not be used for any form of gambling.

Internet

If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of 3B Games which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, 3B Games reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In such event, 3B Games further reserves the right to award prizes to the players with the most points as of the termination date.

3B Games assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries or transactions. 3B Games is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail entry or transaction to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, 3B GAMES RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Any entry that is incomplete, late, does not include a validly issued User ID will be disqualified.

In the event that the Contest is challenged by any legal or regulatory authority, 3B Games reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, 3B Games shall have no liability to any players who are disqualified due to such an action.

Release and Indemnity

Each entrant in the Contest, including, without limitation, the prize winner, hereby releases and agrees to hold harmless 3B Games and its affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, participation in this Contest and participation in any activity related to this Contest.

Limitation of Liability and Disclaimer of Warranties

IN NO EVENT WILL 3B GAMES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SERVICE AND/OR THE CONTEST. IN NO EVENT SHALL 3B GAMES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID FOR THE CONTEST. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE CONTEST AND THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE IMITATIONS OR EXCLUSIONS.

Arbitration

The parties waive all rights to trial by jury in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Oklahoma, in the City of Oklahoma City, County of Oklahoma.

Governing Law and Jurisdiction

THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF OKLAHOMA (which recognizes English common law where not superceded by statute) WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Tournament Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the Oklahoma state and federal courts located in the City of Oklahoma City, County of Oklahoma, and State of Oklahoma. The parties agree not to raise the defense of forum non conveniens.
